Way Better Lists Terms of Service Way Better Lists Operated by Dunwell Labs LLC Effective Date: April 15, 2026 1. Acceptance of Terms By accessing or using Way Better Lists (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. 2. Description of Service Way Better Lists is a software application that enables users to: - Create and manage lists and list items - Create reusable content ("chunks") and templates - Share and collaborate with other users - Upload images for automated processing into structured content We reserve the right to modify or discontinue any part of the Service at any time. Some features are available only with a paid subscription. 3. Eligibility You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms. 4. User Accounts To access certain features, you must create an account. You agree to provide accurate and complete information, maintain the security of your account credentials, and be responsible for all activity under your account. We are not liable for any loss resulting from unauthorized access to your account. 5. User Content A. Ownership You retain ownership of all content you create, upload, or share within the Service ("User Content"). B. License to Us By submitting User Content, you grant Dunwell Labs LLC a limited, non-exclusive, worldwide license to store, process, display, and transmit your content solely for the purpose of operating and improving the Service. C. Sharing and Collaboration Content you share may be accessed and modified by collaborators depending on permissions. You are responsible for determining who you share content with. We are not responsible for actions taken by other users with whom you share content. 6. Acceptable Use You agree not to use the Service to violate any law or regulation, infringe on intellectual property rights, upload harmful or unlawful content, interfere with the Service, or attempt unauthorized access to systems or data. We reserve the right to suspend or terminate accounts that violate these Terms. 7. AI and Image Processing Features The Service may include features that process uploaded images using third-party artificial intelligence services. By using these features, you acknowledge that your uploaded images may be transmitted to third-party providers for processing, results may be automated and may not be accurate, and you are responsible for reviewing and verifying generated content. 8. Third-Party Services The Service may rely on third-party providers including cloud storage and AI processing services. We are not responsible for the availability, performance, or policies of third-party services. 9. Intellectual Property All aspects of the Service excluding User Content — including software, design, branding, and functionality — are the property of Dunwell Labs LLC and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission. 10. Subscriptions and Billing Way Better Lists offers the following auto-renewable subscription plans: - Premium Monthly — $4.99/month - Premium Annual — $37.99/year Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID account at confirmation of purchase. You can manage and cancel your subscription at any time in your iPhone Settings → Apple ID → Subscriptions. Prices are in USD and may vary by region. Dunwell Labs LLC reserves the right to change subscription pricing with reasonable notice. 11. Refunds Subscription purchases are processed by Apple. All refund requests must be submitted directly to Apple at reportaproblem.apple.com. Dunwell Labs LLC does not process refunds directly. 12. Account Deletion You may delete your account at any time from within the app under Settings → Account → Delete Account. Account deletion is permanent and will remove all your data from our servers. Active subscriptions must be cancelled separately through Apple ID settings before deleting your account — deleting your account does not automatically cancel your subscription. 13. Termination We reserve the right to suspend or terminate your access at any time, with or without notice, for violation of these Terms. You may stop using the Service at any time. 14. Disclaimers The Service is provided on an "as is" and "as available" basis. We make no warranties regarding reliability or availability, accuracy of AI-generated content, or fitness for a particular purpose. 15. Limitation of Liability To the maximum extent permitted by law, Dunwell Labs LLC shall not be liable for any indirect, incidental, or consequential damages, loss of data, or loss of business or profits arising from your use of the Service. 16. Indemnification You agree to indemnify and hold harmless Dunwell Labs LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your User Content. 17. Governing Law These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. 18. Changes to These Terms We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. 19.
